Agreement to Terms

Welcome to Tower of Babble. These Terms of Service ("Terms") govern your access to and use of the Tower of Babble mobile application and related services (collectively, the "Service") provided by Fox Dog Software Development LLC ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Eligibility

You must be at least 13 years old to use Tower of Babble. If you are under 18 years old, you must have permission from a parent or legal guardian to use the Service.

By using the Service, you represent and warrant that:

• You meet the age requirement
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and current

Account Registration

Creating an Account

To use Tower of Babble, you must create an account by providing:

• A valid email address
• Your name
• A secure password
• Your religious denomination for prayer personalization (could be none)

Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

Email Verification

You must verify your email address to activate your account. We may suspend or terminate accounts with unverified email addresses.

Account Termination

You may delete your account at any time through the app settings. Upon deletion, all your personal information and prayer content will be permanently removed within 30 days.

Subscription Plans and Payments

Available Subscription Tiers

Tower of Babble offers three subscription tiers:

• Free: Access to basic features with limitations on prayer storage and AI generation
• Pro: $9.99/year or $1.99/month — Expanded limits and premium features
• Prayer Warrior: $19.99/year or $2.99/month — Maximum limits and all features

Payment Processing

All payments are processed through Apple's In-App Purchase system. By subscribing, you agree to:

• Apple's terms and conditions for in-app purchases
• The pricing displayed at the time of purchase
• Automatic renewal of your subscription unless cancelled

Subscription Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You can manage your subscription and turn off auto-renewal in your Apple account settings.

Cancellation and Refunds

You may cancel your subscription at any time through your Apple account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial subscription periods. For refund requests, please contact Apple Support directly.

Price Changes

We reserve the right to change subscription prices. Price changes will not affect your current subscription period. You will be notified of price changes before your subscription renews, and you may cancel if you do not agree to the new pricing.

Free Trial

We may offer free trial periods for paid subscriptions. If you do not cancel before the trial ends, you will be charged for the subscription. Trial eligibility is at our discretion.

Service Features and Limitations

Free Tier Limitations

• Maximum 5 saved prayers
• 3 AI prayer generations per month
• 5 "Pray On It" items
• Access to classic prayer templates

Pro Tier Features

• 20 saved prayers
• 20 AI prayer generations per month
• 10 "Pray On It" items
• Premium voice options from Azure Neural Voices

Prayer Warrior Tier Features

• 50 saved prayers
• 90 AI prayer generations per month (~3 per day)
• 25 "Pray On It" items
• All voice options unlocked

We reserve the right to modify feature limits with reasonable notice to users.

User Content and Intellectual Property

Your Content

You retain all rights to the prayers and content you create ("Your Content"). By using our AI generation feature, you acknowledge that:

• AI-generated prayers are based on your input and preferences
• You have the right to use, modify, and delete AI-generated content
• We do not claim ownership of your prayers or generated content

License to Use Your Content

By creating content on Tower of Babble, you grant us a limited license to:

• Store and display your prayers on your account
• Process your content to generate audio files
• Sync your content across your devices

This license ends when you delete your content or close your account.

Our Intellectual Property

The Tower of Babble app, including its design, features, code, and branding, is owned by Fox Dog Software Development LLC and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our software
• Reverse engineer or decompile the app
• Use our trademarks without permission
• Create derivative works based on our Service

Classic Prayer Templates

Many classic prayers (e.g., The Lord's Prayer, Serenity Prayer) are in the public domain. We provide these for your convenience and do not claim ownership of traditional prayer texts.

Prohibited Uses

You agree not to use Tower of Babble to:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Harass, abuse, or harm others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems (bots, scrapers) without permission
• Create fake accounts or impersonate others
• Sell, transfer, or sublicense your account
• Use the Service for any commercial purpose without our consent
• Promote hate speech, violence, or discrimination

Violation of these prohibitions may result in immediate account termination.

AI-Generated Content

Our AI prayer generation feature uses OpenAI's GPT technology to create personalized prayers based on your input. You acknowledge that:

• AI-generated content may not always be accurate or appropriate
• You are responsible for reviewing and editing AI-generated prayers
• AI output is not guaranteed to align with any specific religious doctrine
• We are not responsible for the theological accuracy of AI-generated prayers
• AI generation is subject to usage limits based on your subscription tier

Service Availability and Modifications

Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. The Service may be unavailable due to scheduled maintenance, technical difficulties, third-party service outages (AWS, OpenAI, TTS providers), or force majeure events.

Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will provide reasonable notice for significant changes that affect paid subscribers.

Updates and Changes

We may release updates to the app from time to time. You agree to install updates to continue using the Service. Some updates may be required for security or functionality reasons.

Disclaimers and Warranties

Spiritual and Religious Content

Tower of Babble is a tool for personal prayer and spiritual practice. We do not endorse any particular religious belief or denomination, claim that our Service provides spiritual or religious guidance, guarantee any spiritual outcomes or benefits, or act as a substitute for religious counsel or clergy.

"As Is" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, OR WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Third-Party Services

We rely on third-party services (AWS, OpenAI, TTS providers, Apple) to provide functionality. We are not responsible for the availability, security, or performance of these third-party services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOX DOG SOFTWARE DEVELOPMENT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Fox Dog Software Development LLC and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of another person or entity, or your Content or any content you create or share.

Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

Dispute Resolution and Arbitration

Informal Resolution

Before filing a claim, you agree to contact us at support@tobprayer.app to attempt to resolve the dispute informally. We will work in good faith to resolve disputes amicably.

Binding Arbitration

If we cannot resolve a dispute informally, you agree that any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except for small claims court disputes (if they qualify), intellectual property disputes, and disputes seeking injunctive or equitable relief.

Arbitration Rules

Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Denver, Colorado, or another mutually agreed location. Each party will bear its own costs, except that we will pay the arbitration filing fee if you cannot afford it.

Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Opt-Out Right

You may opt out of the arbitration agreement by sending written notice to support@tobprayer.app within 30 days of first accepting these Terms.

Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. If you opt out of arbitration, you agree that any legal action must be filed in the state or federal courts located in Denver, Colorado.

Termination

Termination by You

You may terminate your account at any time by deleting it through the app settings. Termination does not entitle you to a refund of any subscription fees.

Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent or illegal activity, your account has been inactive for an extended period, or we are required to do so by law.

Effect of Termination

Upon termination, your access to the Service will be revoked, your account data will be deleted according to our Privacy Policy, you will not receive a refund for unused subscription time, and provisions of these Terms that should survive (e.g., liability limitations) will remain in effect.

Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page, post the new Terms in the app and on our website, and for material changes, provide notice via email or in-app notification.

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service and delete your account.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fox Dog Software Development LLC regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any party without restriction.

Force Majeure

We are not liable for any delay or failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of government, or pandemic events.

Acknowledgment

BY USING TOWER OF BABBLE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.
